Lots of trailers do this. RoTK(or was it Two Towers?) trailer used the Requiem for a Dream theme.

I think that same theme is also repeated in the 'Breaking of the Fellowship', but I could be wrong. Either way, it's definitely from Fellowship of the Ring.

Since WB has the rights to the movie, they are free to use any of the tracks. It's pretty common in trailers, for people to use themes from other movies that are from the same studio.
