It's not an either-or scenario. You can use the death penalty judiciously. You know, for like when people murder their cellmates. Two men go into a cell, and one gets strangled or shanked, you can be pretty sure who your culprit is.

Well, that's nice, but there's no issue here as to whether Hill killed his cellmate.
The issue's whether he's mentally disabled.

The present state of the law is that to execute a "mentally retarded" person infringes the Eighth and Fourteenth Amendments. Criticize that rule if you'd like, but there's no question that it's the rule.
