President Barack Obama's administration is urging the Supreme Court not to take up the first case it has received on controversial National Security Agency cybersnooping.US government attorneys argue that the Supreme Court does not have the jurisdiction to take the case, filed in July by the Electronic Privacy Information Center (EPIC).EPIC believes the NSA overstepped its authority by carrying out broad communications monitoring and surveillance worldwide, and demanded the program be stopped.

Obviously the executive branch has judicial ruling over all matters it deems sensitive. Anyone who's read the Constitution knows that.

Sometimes a lower court, sometimes a state court, sometimes an agency, sometimes Congress, sometimes nobody.

I'm not really that familiar with the legislative scheme or the arguments here, but my understanding is that the NSA's activities are subject to judicial review by an entity called the FISA Court, which is composed of (six?) US District Court judges designated by the Chief Justice of the US.

The FISA Court's decisions are appealable to another thing, which I think is called the FISA Court of Review, or something, and I think that Court's decisions are appealable to the Supreme Court.

I think the argument here is that one or more of the links in that chain has been skipped.
