What is a good class/build for a beginner, least gear dependant?
I'm looking into this game and want to play for fun so I won't be able to grind (kids+work) so I wonder what class would be good choice?
I've played all three Diablo games so I'm familiar with basics and some intermediate stuff but never have done min-maxing really.

LS / GS Duelist and FP / Spork Witch are just as newb-friendly. =)
Personally, a witch summoner ought to be pretty new-player-friendly as well as gear-independent as well. As long as you have Minion Instability before you hit the Act 1 Normal boss fight and keep Summon Skeletons you shouldn't have any serious boss fight issues, you can have the core of the build done before the end of Act 3 Normal, you can go until Act 1 or Act 2 Merciless at least with just skeletons (even without a totem), and several of the unique items that aid the build are not only cheap, they're usable under level 25 and useful until at least level 60. Heck, with my witch I went from level 25'ish until level 60 only making 4-5 upgrades. I upgraded her body armor twice, her helm twice I think, and her gloves once.
I'll grant that summoners aren't fast, and they aren't as in-your-face fun as other builds, but they are most definitely the "slow and steady win the race" build. My witch's skeletons are generally capable of handling most anything by themselves thereby leaving zombies to be meat shields between my witch and things that might kill her. Spectres are of debatable value though. I say that not because they're bad by any means but because you have to both use the right NPCs and the right support gems to truly make them shine, and even then they're often prone to dying much faster than you might like. Even with minimal support, which is to say Lesser Multiple Projectiles and Minion Damage, some spectres, like the "tentacle" b****es from Lunaris 2/3, will decimate hordes of mobs. Other spectres, like most melee types, will suck hind tit.
Something else you could do for fun is to mix the summoner with Conversion Trap and Multiple Traps. Conversion Trap's minions are only short-lived, but it does make things a little more interesting as well as providing for that whole "divide and conquer" thing.
Just um, just be aware that summoners, like sporkers, are not everyone's favorite party member(s).

I made a pretty decent sporker out of a level 25 shadow I had made into a frost nova witch. I just took back all of the cold damage and used lightning nodes. I have pwned everything in my path all the way to 70 with the crappiest gear. I can do 66 maps very well but i'm going to need to farm for better gear. So as a budget build a sporker is very viable and with good gear even more so.

That build has issues, it's actually gear dependent...maybe not as much but it's pretty up there.
EA Mara or duelist is the cheapest most effective build
If you have little currency then It's Lightning arrow.
If you have decent currency facebreaker is fun as hell.
With 1.0 on the horizon there will be changes to the passive tree and balance fixes. Including MF changes.
Even Sporkers may not even be an option anymore.
