Maybe it's because Nintendo already knows about their "kiddy" image. Said image makes parents feel safe about getting their kids Nintendo consoles. This means Nintendo has a large young audience, which results in the need for them to be toght when they moderate the Miiverse. I doubt they'd be so tough on moderation if their young audience wasn't as big.

Also, the guy kind of deserved it. I mean, yes, this is ridiculously strict. But when your post gets modded for including "WTF", you don't go and make another post with "double u tee eff" unless you want to get banned.
Everything after the gamecube is just so childish any console that my 70year old dad wants to play isn't for gamers.
DS is good but I still like my Gameboy advance SP now that was a great console

I would still have a stricter ToS if it means less people being complete ass hats about everything. You can still express that you don't like something as long as you don't say "This is a gigantic piece of f****** s***. all you f****** who buy this are F****** stupid." I've seen plenty of negative comments.
