Is there a reason a few titles are unavailable for download in the Eshop?

Mainly it is Black Ops 2 and Mass Effect 3. Why aren't these available to download?

because they're not available to download on other consoles either? I dunno about ME3 but you can't get Black Ops 2 on PSN

I was wondering why that is. I went digital download only, and would like to download Black Ops 2.
