The laws related to copyright infringement have been getting increasingly stringent over the past 20 years.

You could get away with just about anything in the 90s, nowadays if you fart and it sounds slightly like a copyrighted song you could probably get DMCA'd.

It would more than likely be the latter, I'm pretty sure Itoi himself had next to no say on the matter and personally said that he'd have let it go through, i'm not sure on that though.

Honestly if you listen to the music, yes it sampled but it's still not enough to cause an issue in my opinion. But as far as some of the dialogue goes I bet they tweaked a few things to avoid possible issues. Bill Trinen recently stated that the music was unchanged.
