I'm really disappointed, we were promised Earthbound on the Wii VC 5 years ago and it turns out the reason why they never followed through was a big lie.

OR, they ironed out the legal issues.
It took Capcom what... a year and a half to get TvC to North America?
And that had less licensing issues than Earthbound.

I'm pretty sure Nintendo never claimed the music was a legal issue, that was just fan speculation.

I was never really convinced that legal issues were behind local Earthbound releases. Other games have references and music based on copyrighted material and there's no problems with those games. It was fairly clear that Nintendo didn't believe there were many Nintendo customers who genuinely wanted it. Miiverse showed them that they were wrong.
