Fair use can be commercial. I don't think any LPer could win a court case on fair use grounds anyway, though. There's a point where you're using too much of the original work for your product to be considered fair use. I'm pretty sure no matter where you are and what judge you draw $100% is above that limit.

It'd seriously have to be a pretty lame game for someone to feel that by watching someone else play it they've experienced all the game has to offer for themselves.

I feel like LPers should be making LPs for the fun of it. I don't see why that's even something they can be paid for, it doesn't take a lot of effort to just play a game. I'm on Nintendo's side of this, but.... idk

To be fair the work mainly comes from editing.

Though going back to Team Fur Star, they've produced a crap ton of DBZ Abridged and make zero money off the videos and that takes far more effort the LPers ever do.

I feel like LPers should be making LPs for the fun of it.

I feel that we should live in a magical wonderland where gumdrops can be picked from trees and spontanious musical numbers erupt whenever someone says the secret word of the day.

But more seriously it's the same as anything else. I doubt anyone, with the possible exception of He Who Must Not Be Named, makes enough money from their LP vids to quit their day job but the more you make the more of your time you can afford to invest in something.

And this again why it seems self-defeating to me. If you're popular enough to be worth "going after" why the hell would you keep doing Nintendo vids after this? Heck, just having old Nintendo vids on your channel is a risk to your good standing. Take say The Runaway Guys with their ~117 million combined video views - that's a hell of a lot of free advertising Nintendo's killing there that didn't cost them a single cent.

While I'm not against Nintendo taking their cut, I see an awful lot of elitism in this thread. These people are producing Let's Plays, not pornography. I'm sure there is some work involved in editing the footage (what to cut, when to sync. etc, yes, it's not nuclear engineering, but there's some effort involved), and nobody is forcing you to watch them. I'm not really an LP fan, but it's hardly "despicable".
