I have heard the smartglass patent came out first.

Smartglass is just a tablet or phone though. No controller.

The GamePad feels like a second screen for the console. SmartGlass feels like I'm looking at a web page on my phone. They're not even remotely the same.

I wouldn't say copy, heavily influenced, yes. And anyone who things otherwise probably also think the existence of Kinnect and Move have nothing to do with the Wii's success with motion gaming.

Smartglass came first. And Nintendo didn't come up with "miracast". Hell even the PSP did the same thing as the Wii U but first.

Move came out first, first demonstrated in 2000.

Guy who invented the Wii Remote didn't even PITCH it to Nintendo until 2001, and they were the last people he even brought it to.

Why did they decline it? Because, at least in Sonys case, they already had the same thing in development in their own labs.

its more of the design they copied... Motion controls were out decades before any of these 2 were out... Does that controller you see in 2000 look anything like what we actually got? Does what we ended up getting resemble the WIi mote and Nunchuck a lot?

"came out" and prototyped are two different things. Sony clearly didn't think much of the technology since they sat on it for 10 years before releasing a version of it that looks exactly like the Wii controller set up.
