Intelligent Systems are a first party development studio of Nintendo. All of their work (Fire Emblem, Paper Mario) is Nintendo property. Its no different than the Metroid or Donkey Kong titles made by Retro Studios.

Technically, Game Freak is a second party developer, not first. While Pokemon is jointly owned by Nintendo and Game Freak (and The Pokemon Company, and Creatures Inc), Game Freak itself is an independent entity that simply develops solely for Nintendo platforms.

Yes, but apparently Sakurai needs to ask Intelligent Systems' permission to use Fire Emblem characters. (Or at least he did during Melee's development.)
