Yes, but apparently Sakurai needs to ask Intelligent Systems' permission to use Fire Emblem characters. (Or at least he did during Melee's development.)

they are like gamefreak so yes.

No, Game Freak is a second party developer that makes games for Nintendo to publish. Intelligent Systems is 100% owned by Nintendo, so they're first party.

it was a comparson of developers

Yes, but not an entirely accurate comparison. Intelligent Systems is more Nintendo than Game Freak is.

Is Marth?

Marth is Nintendo material. Chrom and the rest of Awakening is not.

Um.... what? How do you figure that?

^Game Freak is a second party developer that makes games for Nintendo to publish so they are still partially nintendo.

Whether you consider FE first- or second-party, it really doesn't matter much for inclusion.

Game Freak is not owned at all by Nintendo, they just make games with IPs that are owned by Nintendo. Intelligent Systems is completely owned by Nintendo, and are a part of Nintendo.

Intelligent Systems are a first party development studio of Nintendo. All of their work (Fire Emblem, Paper Mario) is Nintendo property. Its no different than the Metroid or Donkey Kong titles made by Retro Studios.

Technically, Game Freak is a second party developer, not first. While Pokemon is jointly owned by Nintendo and Game Freak (and The Pokemon Company, and Creatures Inc), Game Freak itself is an independent entity that simply develops solely for Nintendo platforms.

To clarify, the Pokemon Intellectual Property is owned solely by Nintendo, however, because GameFreak creates the games, they own part of each title. The Pokemon Company is a Nintendo affiliated Brand Management company resonsible for marketing and distribution, as well as the Trading Card Game, television shows, and movies.

Nintendo pays these two companies to handle the IP for them.
