Let's make a tier list of third party companies! By this I mean, a tier list of how likely they are to get a 3rd party in the game. For example, pre-Brawl, I would say Sega is high tier and Konami was mid-tier (but not for Snake). This also goes to show us that tiers don't mean everything!

High tier: Konami, Sega, Capcom, Namco

Mid tier: Atlus, Square Enix, Ubisoft

Low tier: EA, Activision, NIS, Level-5

Feel free to add your own lists, I will probably edit this post later because I am sure I am missing some third parties.

High Tier: Sega (Sonic), Konami (Snake), Capcom (Mega Man)

Mid Tier: Level-5 (Professor Layton), Namco (Lloyd Irving/Cless Albane or Pac-Man)

Low Tier: Square Enix (Geno)

Atlus mid-tier? We should get a Persona 4 character. Or at least people could talk about one more than they have been. Although I don't really find an Atlus character to be that likely.

I dunno, Atlus has been working with Nintendo a lot lately, what with Soul Hackers, SMT IV, FE x SMT, and the Devil Survivor games. Mid-tier seems reasonable to me, though I wouldn't get my hopes up for a P4 character if I were you; they don't satisfy the "must have appeared on a Nintendo platform" condition.
I've stopped caring about a lot of things. But not Sonic. Never Sonic. :P

I did it partially based on how likely I think they are to get in. Konami is very high up, because, well, they already got one in.
