Because even with the other 4 leaked characters that still only adds up to 23.

So we still get to see 15 others that people want in the game.

Suezo? The eyeball monster from Monster Rancher? Seriously?

That would be my issue with a character roster of 38; filler. I can't imagine characters like Croc adding a whole lot of unique moves either.
