if so I might switch from ps3 to xbox in Nov. I hope it comes out then. :) and I hope it has blue ray and windows 8. and at lest a good shooter and racing game

Neither. It is reported to have its own "metro" interface but the OS will be unique to the nextbox.

It is expected to share many of the same libraries and frameworks (.net) as windows OS though much like the current xbox.

You're being obtuse. Microsoft would have to pay licensing fees, a portion of which would go to Sony. Saying that they'd have to pay licensing fees to Sony isn't fully correct, because it's not a direct payment, but it's mostly correct and it is far more correct than your "no they don't".
