Retailers could sell used games as new games?

Just think about it, there won't be any difference between a new case and an used one. Also as many microsoft defenders have said, you only buy the license, the permission to use the bits who remain new.

Also this is a win/win/win situation. Microsoft, developers and retailers like gamestop win money, everybody happy.

That is exactly the same idea behind paying full price when bringing your game to a friend's house and play on their account, the only difference is you have a physical disc

With the difference they would give you some money for the return of the license.
