Will gamestop get sued for selling incomplete games with no refund? (forza 5)

Forza 5 for Xbox ONE will be incomplete right out of the box.
You are required to connect to the internet to download the rest of the game.

So lets say you don't have internet connection OR, you have very limited data.
Will gamestop refund your new game or be forced into a lawsuit?

Hopefully they will put up large disclaimers telling consumers that they will need to be online to even make the game run.

Personally IMO, I think Forza 5 will likely flop because of this.

It is playable out of the box.
And I'm sure that the box will state "update required for full enjoyment" or something

I can tell you that Forza 4 is the title that made me preorder the X1, like AC4 before with the 360. Easily my most anticipated title at launch. Glad I have great internet and don't live in the sticks.

Shops have been selling incomplete games and non working games for years, even The Last of Us did not work day one (saves).

The game isn't incomplete exactly, Microsoft or turn 10 idk which said the game was playable right out the box, but due to it needing to be certified they couldn't add all the features which is why they are adding more afterwards. More tracks etc.

This is nothing different than gta 5 with gta online. It means they get extra time to work on other features and add more content without having to delay the game.
