Do you think Microsoft should make publishers put a disclaimer on the game cases

If a game is upscaled to 1080 vs native?

Never work in marketing.

i don't think that would be ms responsibility, or even within their authority.

This would most likely be buried in the EULA already just before the ever encompassing line "by purchasing this product, you are lawfully agreeing to our terms..."

Why? Both Microsoft and Sony have been putting 1080P on cases when they're just upscaled for years now.

MSFT has made more money in the last quarter than SNE has in the past 5+ years.

Why? Neither Sony or MS has done that this gen and there has been no legal repercussions. Companies usually don't put frivolous disclaimers on things until prompted by a frivolous lawsuit.

Or did you think someone at a storage tub manufacture thought it was necessary to put a warning label on them to not put children in the tubs right off the bat?

Wii U upscales everything to 1080p, no disclaimer

That's true but this gen is different. I think as consumers everyone should have a right to make a informed purchase. Especially when people start buying both systems and want to know which multiplat version to get
