It's a moot point. You forfeit rights like that when you agree to the ToS if applicable. Same thing happens on Gamefaqs. You can say whatever you want, but the moderators can remove that message if its against their rules. Freedom of speech doesn't apply in situations like these nor does it mean what most people assume it means.

You give up your 1st amendment right when you sign a service agreement with microsoft. Also the 1st amendment means you won't go to jail for it, it doesn't protect you from everything like many people think.

You do understand that the First Amendment does not apply to companies, right? It prohibits the GOVERNMENT from limiting your speech (though the Supreme Court has caveated that).

Using Microsoft's services is an implied agreement to abide by their rules.

also a private network can set its own rules with a ToU wich you agreed to like gamefaqs.
