How can MS know whether you are playing a used or a pirated game?

If I want to buy a used game from a person who usually plays pirated games on his console. Any chance that MS bans me, from playing this used game?

If you want to be safe, you could disconnect your 360 from the internet. The only way Microsoft would know if it's legit or not would be to play it while signed in to Xbox Live.

Microsoft can not ban you for playing a used games.
And a pirated game wont even start on your system unless you got the piratefriendly custom firmware installed on your system.
Heck, just take a look at the disc before you buy it, it's easy to see th edifference between a pirated and a original game...

And if that's the case, tc, it doesn't matter what you play, you can be banned for having a modded console.
