I really dislike the idea of Gamestop letting their employees play new games before they are even released, or after release then still selling the copy as friggan used.

Let me go back and explain this a bit.

I live next door to a Gamestop employee. A few months back on a friday he came home while I was outside, carrying a stack of new games. I was like cool, went on a spending spree, what did you get?

Nope, they were brand new games, two or which were not going to be released till a midnight opening on Monday. He was going to play them through, gut them and put them on the shelf to be sold as new.
When I confronted the manager about this, he said "Well, we're allowed to check out new games to try them out, however he shouldn't have let you see them or tell you they were the store copy.

Yesterday, I saw my neighbor playing Lollipop Chainsaw on Xbox Live. So I sent him a message asking if I could barrow it when he was through. His reply was "I didn't buy it, it's the store copy." This urked me quite a bit.

So, still wanting to play the game.. I went to Gamestop today to BUY Lollipop Chainsaw. All they had was the "Gutted" copy in. The one my neighbor had been playing but he wasn't on duty at the time. When they tried to sell me it I said I didn't want it I know it had been opened and used. Their reply was "No one has had time to try this copy out yet." Which I know was a bold face lie.

My fiance quickly retorted, "Well, according to your policy once a game has been opened, its used. So this game is used, good bye" and with that we left the store.

As I said, NO GAMESTOP I DO NOT WANT TO BUY YOUR STORE COPY.
This practice is total BS in my opinion.

I hear that it is illegal to sell opened copies as new in Cali and this practice has been abolished. Is this true? Hopefully this rule will become nation wide soon.

Nah hidden stuffs are still in games these days...
you just have to pay for them. Capcom calls them DLC.

Why in the Hell, aside from pre-order bonuses, would anyone buy a new game from GameStop? That abomination has mastered the art of bending people over, and has no lubricant dealer in their Rolodex.

I honestly only buy new from them. It cuts into their profit and hurts employee sales.

Employees hours are based on how many pre-orders they make vs regular sales. Every sale without a pre-order actually hurts the employee because it brings down their pre-order % of the day.

I really don't know why I shop their besides pre-orders.

Gamestop might have changed things since I worked at Software Etc a LONG time ago (the two eventually merged), back then, you could ONLY 'check out' a game after it's release, and if it was a hot title, we had to wait a week or two, customers that wanted to buy the game were more important, as it should be.
But as I said, maybe things have changed over the years.

Or the manager just doesn't care.. or they had an excess... all of these are quite possible.

It's a tough world. Deal with it.

Let me go back into this a small bit.

I said this many times before, but what GameStop is doing is actually illegal to begin with. Its not just a state law, its a nation wide law and its called the Uniform Deceptive Trade Practices Act. So in short term, GameStop in general is breaking the law in every state.

"represents that goods are original or new if they are deteriorated, altered, reconditioned, reclaimed, used, or second-hand"
