They changed the price so it's $10 or more less, so if you buy the online pass it is the same price as retail.. or like $3 cheaper then retail after the pass.

They do have that on the box in small print. Ontop of that California law now requires used games that require a pass to have a sticker on it in large print saying it.

As you said the guy is a moron, however how many morons have gotten laws passed and lawsuits won? (Hot Coffee in Lap, Don't stop fan Belt with your hands.. etc)

I tend to buy new at Best Buy or Amazon. Xenoblade Chronicles was a special exception though.

I purchased my son a New copy of Lego Harry potter 5 - 7 at gamestop being sold as new. When I finally looked at the game while we were shopping at walmart I was pretty suprised to see the disc had tremendous amounts of wear, especially considering it was being touted as a new game.

Walmart had the same, sealed new copy of the game for the same price 20. I took back that so called new game to gamestop and was like

I bought this game, it was supposed to be new, but it's clearly not. Employee said something along the lines of oh I can give it to you for the used price.

Really bro, so does that mean someone either bought a used copy and was given my new copy, or does that mean you guys repackaged a used copy as a new game? I'm going for the ladder. I'd love to see Gamestop get nailed on this policy of opening up new games, and still selling them as new.

IMO once the Microsoft seal is broken that should make the game a used copy I'd imagine.

preorders never get opened...other new copies do however...it's basically done to get rid of preorder bonuses that may be inside the case of the game to help encourage preordering (at least that is my opinion as to why they do it)

I've never encountered that. I remember they did get in trouble for gutting Deus Ex last year when it came with a free download copy to get rid of the free DLC.

Other then that the stores around here only gut one copy to be the shelf/store copy. That copy is then allowed to be checked out by employees. The copy then, after being gutted and used is being sold as NEW. Both practices need to stop, if it is gutted it is used IMHO, if it is played.. it is user. PERIOD. Gutted copies should be sold as used, or at least as a discount.

I agree...but again, we all know this policy by now that Gamestop has...should we be surprised by it continually? Again, I agree with you & TC, but it is what it is. Personally if I am not preordering, I usually buy new someplace else other than Gamestop, that way I'm not another Gamefaqs statistic in these types of topics.

Like I said...I agree whole heartedly...what it's going to take for that policy to change is one of two things ..Enough people stop buying their games there (not going to happen at this juncture) or a class action lawsuit (which is most likely what will eventually happen) and this will be filed away as a frivolous lawsuit in the annals of history, when in fact it wouldn't be.
