No and no. Cross game chat is not in because of some certain old games that don't have an ingame XMB. I think they're some EA games.

I'm pretty sure that crossgame chat isn't in because Microsoft patented it. I'm also pretty sure that an integrated system in the OS for custom soundtracks is something Microsoft patented. Developers can choose to give games that feature individually, but it must be build into the game. Sony isn't allowed to put that feature in their OS.

That is wrong, the Vita has cross game chat.

Probably because it's on a handheld. Patents need to be pretty specific. Sony is also probably allowed to come up with an external device that allows cross-game chat for the PS3.

This. Patents mean nothing when it's just code. Someone explained a long time ago, that there are innumerable ways Sony could program the cross game chat and soundtracks. Just because Microsoft hold a patent for one, or a couple of ways, does not mean they hold one for all ways. And they don't. If Sony really wanted to they would put cross game chat on the PS3. But I think I read somewhere that it wont work because of the way the XMB does and they'd have to recode it from the ground up or something like that.

So yeah. Sony are allowed to put cross game chat and in game soundtracks into the OS. They just have to redesign the entire thing. No big deal right?

Or they could just add Skype to the XMB and do it the easy way. Matter of fact why haven't they added Skype to the XMB?
