You don't own the disc, you paid for software. The publisher can put whatever they want on the disc and use however they want to. If they have the devs put out some DLC and get it ready for launch and then have it locked away on the disc, it is no different from normal day 1 DLC aside from instead of downloading several large files it's just a few KBs. THQ did that all the time, like the WWE games would have a day one season pass and all the new wrestlers were on the disc but unlocked over the first few months and Saints Row 3 had most of the DLC on the disc and also outfits worn by NPCs that were sold back to you. It's shady but perfectly legal. They own the content and they can choose how much of it you can use and they can sell it back to you later on.

You do own the disc actually....

I don't recall WWE games or Saints Row 3 being shown to have the stuff on disc, were all the so called DLCs 100kb in size (indicating an unlock key as opposed to actual added software)
