HP based tear and respective upgrades, who is OP with it?

Perhaps make it stack up whenever you get hit (2 or 3 HP per hit taken with a small cooldown) so it's only a jungle item. Not good in lane.

Then it can be balanced to be a slightly more cost efficient version of Warmogs (with maximum 1200 HP rather than 1250). Also built from Kindlegem + Tear-esque item. Give it a unique passive that gives you additional CDR% based on .05% of your max health. 3K health > 15% CDR.

Costs about 2700g total. So potentially a slightly cheaper Warmogs with CDR instead of HP5. Junglers only. Seems legit and balanced.
