I definitely think they should have used a capacitive screen. Although I don't think it has even been stated yet what screen type is being used, all focus has been on the top screen.

From hands on impressions, I've read that the screen is at the very least pressure sensitive or more so than the DS/DSi. If that means anything.

This is what we know about the screen:

Touch Screen:
3.02-inch LCD with 320x240 pixel resolution with a touch screen

That's it. For all we know it could be multi touch, capacitive etc. We'll just have to wait and see. I was personally hoping for a current smartphone grade touch screen, multitouch is kinda neat to use.

oookok kool thanks for that info. i was wondering what changies they made if any because it seems like they want to keep up with the iphone calling it the "enemy" and all. A capacitive screen would do good to the sometimes iffy touch screen controls along. imagine wario ware being able to used two touch inputs at once . it would make for interesting gameplay to say the least.
