I have a "The Day After Tomorrow" dvd case with a special hologram cover and it has 3D effects. There's been variations of 3D lenses like this and Nintendo is the first to go digital, I doubt a lawsuit would be taken seriously.

It wouldn't surprise me if there was a lawsuit. Troll companies you have never heard of in your entire life love to make stupid lawsuits to get media attention. Remember a couple of months ago when some joke company nobody knows about claimed to be the leader in wireless technology and sued Nintendo, Sony and Apple for having their devices automatically connect to the strongest network available? Yeah, even common sense seems to be copyrighted nowadays.
