Can the 3DS pick up street passes while playing an original DS game?

Or is it only during 3DS games?

Also can it do it with it closed?

No it can't, it's just on the menus or playing 3DS games. I believe it has to be closed, as well, but I'm not sure.
The pedometer does work while the 3DS is closed while playing a DS game, though.

It will NOT street pass if:
You are playing a DS game
You are playing a DSiware game
If your system is asleep with a DS/DSiware game running
You have your wifi switch off
You haven't turned on street pass

It WILL streetpass if:
Your wifi switch is on
You turned on streetpass in the options
Your system is asleep (no DS/DSiware games running)
You are playing a 3DS game that doesn't require a wifi connection (ex. Zelda:OoT)

I think that's everything.
