How can this not work? You are allowed to return the 3ds at Best Buy without having to pay for any restocking fees. If you are within the 30days of purchase (45 days for premier sliver), you can return your 3ds and buy it again for the lowered 169.99 price once it is available. It is too bad for those early adapters who are past the 30(45) days of return policy, but this is no scam, and also it has nothing to do with price matching, if that is what so many posters here are arguing about.

Nintendo can tell you that all they want, but unless they sit on the retailers board in a controlling position, they are just telling you what you want to here. Nintendo wouldn't risk pulling the 3DS out of stores over a price match they can't control. It would only hurt them in the end and kill their holiday instantly. So believe Nintendo all you want, but they're in no position to be informing retailers of anything. They can't afford to not have 3DS' being sold by telling the retailers that offer to give their money to customer's that want the price matched.

Unless they change the wording on their policy which no one has for the 3DS. Then suing the company is always a option, in which case they will have to pay the difference and lawyer fees.

The whole thing is, if you can return it, nothing is stopping you as a customer from doing so.

So, on August 12th, you can walk in, return the 3DS, they will have to spend money on labor for testing it out, repackaging it, and sending it back to the manufacturer. They will also lose out because a 3DS system that could have gone to a new 3DS customer, is just being exchanged. Therefore, they lose money on that sale because they spend their cash on getting rid of your perfectly fine unit.

Or, you can ask about their 30 day price match guarantee an they will price match it there. Ive price match my television there before, I bought it for 999, and it went on clearance 27 days later for 699. No questions asked, just a smile and a thanks for stopping in.
