How does the loophole work?

My 3DS is under warranty still. Can I return it to Walmart, claim it doesnt work right (they don't care anyway), get a new one for the new price, sign onto eshop with my linked Nintendo account and get all the bonus games still?

You could only take it back if you're still in their return policy window. Be advised that any purchases on the eStore up that point will be lost as the eStore is tied to the system, not your Club Nintendo account.

I'll try it. Either way I'll come out with $80 in free games or $80 in my pocket if it doesn't work.

Being under warranty and being under the 30 days return policy are 2 totally different things.

Walmart's return/exchange policy for electronics is 15 days, FYI.
Nintendo gives you a 1 year manufacturer's warranty.
