It takes some systems time to pick up steam I remember the Ds library was a little lite to begin wit but in the plus said the eshop is great love 3d golf.

Bad timing, bad price point, bad starting lineup. The 3DS was a failed launch, that much is for sure: it would've been better served being delayed to Fall, with Christmas around the corner and more companies delivering more titles.

At this point, the 3DS is sitting on the edge of a death spiral. The price cut is not enough: the system needs games. If it doesn't get games, people won't buy it. If people don't buy it, it won't get games. See the Catch-22? Its failure is not a foregone conclusion, but if it slips over the edge, Nintendo will be in for the fight of their life to keep their handheld dominance alive.

It's too early to call 3DS a failure. Give it until next holiday season, and we'll see whether it shapes up or ships out.
Just to be safe, until I see more data I'm going to assume cancer causes cell phones.

It's only a failed console if they quickly and completely discontinue all hardware and software development for it without any kind of successor to replace it.
So no, it hasn't failed.
