It has to be a game specifically for the 3DS.

*Edit: Sorry but for the wrong info earlier but the pedometer works even when using DS software and games.

Uh, no.
I've received steps while having a DS game in sleep mode.

TC, here's how to find out for yourself:
1. Write down your steps.
2. Start up a DS game without shaking the system.
3. close your 3DS(make sure you're not saving or running wireless communications)
4. shake your 3DS for about 2 minutes.
5. Exit out of the DS game without shaking your 3DS.
6. look at your number of steps. You should have more steps than before starting the DS game.

PS:
No matter what, spotpass & Streetpass don't work with DS(i) software.

When you have a DS/DSiWare game suspended, it turns off all of the features including StreetPass. But if you exit the game and suspend your 3DS at the menu, the pedometer will work.

Street pass / Spot pass functions will not work when in Sleep mode while running a DS game.
Pedometer, however, will work just fine.

I know this because I just finished dragon quest 9, which I used to play before work (then close and walk) in the bus (then close and walk) at work, during breaks (then close and walk) in the bus again (then close and walk) and a bit at home before exiting the game for the first time on that day - it has then counted all my steps and I have 10 coins extra.

Yeah, I just tried it now and the pedometer does work but all communication features do not. Editing my post now...
