If nintendo does release a new version.

While the current one is still under warranty, and they have to replace one, Will they just give people the new version?

Probably not, theyd just give you a refurbished original model, though I could be wrong

I don't think everyone's warranty can last long enough for that. Nor does the warranty cover such things as a new system's release.

But that doesn't mean they couldn't do some sort of exchange program if they want to. I think many folks would be keen on going through it if meant getting a "better" system for next to no cost. If they can make the Ambassador program work, I'm sure it wouldn't be too hard to do something like an Old For New 3DS exchange.
