The update removes the sleep mode button. The 3DS goes into sleep mode when you close it anyway so don't worry about it.
You need to set the 3DS up to your wifi before it will update. Just go to internet settings>Connection Settings>New Connection and you can click on the tutorial the system offers, or if you feel confident enough you can do a manual setup.
