The truth is Nintendo has a good chance that a company will not give them permission to use the music, so they could start paying and still have some unavailable. And they probably think that they would not get the money back due to the fact that the fanbase is not as big as most current games.
If it costs them too much all Nintendo would have to do is throw Mario into the game somewhere and call it "Mario's Mother."

actually, it's been discovered that they made that change before the game was even released
using the debug code on the earliest version with the new song shows that the completion date predates any region's release of the game

Well, him then. Operation Rainfall sent a letter to NCL once, they should put together a petition to send to him asking him to change the music and let the game be rereleased.
Yeah, because Operation Rainfall is so successful. Maybe they can buy some more Square Enix games and then keep wondering why Nintendo only tells them no.
I still find it hilarious that Operation Rainfall takes credit for doing anything. They failed. Then Nintendo released those games on their own. Operation Rainfall had absolutely nothing to do with the actual releases of those games. Nintendo changed their mind long after OR had failed.

I don't really buy this reason since it doesn't explain why the game hasn't seen release on the Japanese Virtual Console. Frankly there's more blatant music sampling in other games on the Virtual Console and Nintendo's overreacting. Or this is just a rumor, I don't know.
We probably never will find out the truth. Shameful though, I'd love to support an official rerelease of the game.

I wonder why this is such a worry with this obscure title when Doom, one of the most popular games of all-time, ripped off tons of songs and got away with it (and continues to get away with it in each new release).

Exactly! I'm gonna just continue to enjoy all 3 Earthbound/Mother games the same way I always have... Sorry if some people don't like it, but being as how 2 of the games were never officially released in America and it appears that none of the games will ever be rereleased at all in any region, I believe that playing these 3 games via emulation is justified...
