Question regarding spotpass (ex. Mario Kart 7)

To get people into my Mario Kart 7 channel, do I need to have the game in my 3ds or can I simply have any game in while in sleep mode?

I got two people but I was in the middle of playing Mario Kart 7 and put it in sleep mode so I was curious.

You don't need the game to be in the 3DS is receive Spotpasses or Streetpasses for that game.

However, there is a limit on how many Streetpasses you can have queued up for a particular game, then it stops receiving more. The queue size varies from game to game: it can be as low as 3 , like in Super Mario 3D Land, or high as 50, like in Kid Icarus: Uprising. To clear a game's queue, you just have to run the game and check the Streetpasses.

Ah okay. Thanks for the info!

Another question. How would the 3DS know if you have that game to recieve Spotpasses/Streetpasses? I assume once you put the game into your 3DS for the first time, it will save the info onto the system so you can recieve Spotpasses/Streetpasses for it?
