Just got the Nerf Armor 3DS XL case?

Is it me or does Nerf Armor Case actually make it so the top screen of XL doesn't touch the bottom screen, I have something in between the screens so the bottom screen doesn't scratch the top screen but the Nerf case still seems to completely close?
