Wondering how my launch blue 3DS is still under warranty?

Before I say anything else, I just want to point out that each time you send in a system to Nintendo for repairs, they extend the warranty by 1 year from the date you get it back.

I sent it in for repairs a couple months before its warranty ran out the first time for a damaged circle pad (the gray plastic came off) and screen scratching to the top screen protector in 2012. I had asked them to extend the bumpers. When I got it back, I placed screen protectors on it again. Soon after, the screen scratching occurred to the screen protectors again and it was obvious they did not extend the bumpers.

Around December of 2012, I purposely removed the screen protectors (so the screen scratching would happen to the screen) and sent it in for repairs under warranty just as an extension to my warranty.

Well now a serious problem has been occurring to my 3DS. Whenever the system is running software that is rendered in 3D, the top screen goes very dark. However, this effect immediately stops when I run something that isn't rendered in 3D, like the Internet Browser or Donkey Kong (GB). Turning up the brightness and turning off power saving mode usually helps, though sometimes it gets so bad that it goes pitch black at 5 brightness while plugged in. However, sometimes this effect does not occur at all.

Now here's my dilemma: I have FE:A digitally and I'm worried about losing my saves in the repair process. If they end up having to replace my system, would I lose access to the data on my SD Card and have to redownload everything?

When ytou send it in, include the note that asks them to please preserve your data (if they can). I recently had to have my top screen replaced and asked them to preserve my data and everything came back intact.

Do I need to include the SD Card for them to save the data?

They'll tell you whether or not to send in the SD card. This last time, I sent mine in. Probably couldn't hurt to make a copy of everything on it if you can, as well.

You forgot a "Yes" option that entails you sent it in, but Nintendo deemed it was not a manufacturer's defect, and that the damage wasn't caused by the user either.

Well I called and set up a repair. I'll be sending it in a couple days, as soon as I get the shipping label in the mail.
