The thing that sucks about shoulder buttons on any DS or 3DS system dying is that it almost always happens outside of the 12 - 15 month warranty period. Nintendo probably knows of the problem but covers their asses by offering a warranty that expires before the problem happens. Then Nintendo monetizes the problem by charging obscene amount of money to fix the issue.
I'm lucky I have always had a shell on my 3DS. It makes the buttons feel much lower than they are, so the L/R don't get any pressure in my pocket and since there is plastic around them, they are less easily dust attacked.
