You could contact Nintendo.

Call Nintendo Customer Support.

With your Club Nintendo info, your system serial number, and the serial number of your new system they will be able to consolidate your eShop purchases.

Unfortunately, you are out of luck. Due to Nintendo's archaic policies, games are tied to the system. So the person who will buy your old 3DS will be the new owner of the games.

You need the code on the back of the system (if you put it with your club nintendo account) and the account information and Nintendo will give you back you games. Why would you get rid of the system and then decide you need stuff back from it?

I hope you have that info so you get your stuff back...good luck sir...

You are out of luck. Due to Nintendo's stubborn idiotic policies your digital games are stuck on the system you bought them on. Nintendo is failing big time.
