I had my last 3DS go black screen of doom and got a new one delivered, I kept my SD card but my digital games are not on it (my save games and stuff are still here but) how am I able to go about getting my digital games back without repurchasing them?

Sounds like you're going to have to call Nintendo to change the account to your new 3DS.

Yep, just tell them you have a new system and need the NNID moved to it and you're not interested in having the old one repaired.

Your digital game saves are pretty much a lost cause, but if you tell Nintendo they can transfer your purchases to the new system, then you connect to the eshop with the new system and redownload them.

Right, so should I hold off on making a new NNID on the system or should I make one ready so they can transfer to the new account?

Don't make a new NNID. Once you have called Nintendo, you will use the information from your previous NNID.
