Already paid for the game, just can't play them on modern consoles. I'm not giving the game away or selling it, it's just in a box in my room. They aren't even letting me buy it again even if I wanted to. If they won't sell it to you, it isn't piracy.

Then if somehow for some reason a police squad arrives at someone's house and demands to know why he downloaded Kirby's Dream Land they can just show the case and be all "I got it, just wanted to play it on my x as well." Then we can all be happy the police were spending money visiting someone for downloading Kirby's Dream Land instead of stopping a murder six blocks down.

Yes, that's totally how it works. The cops aren't going to beat your door down to see if you downloaded Kirby, so it's legal. Aren't you a god damn genius.

It's illegal. Period. You only have legal right to your own back ups. If you didn't dump the rom, then it's someone else's back up, not yours.

This is all purely hypothetical. I've got way too many Steam games right now to worry about playing Kirby.
If the person did dump the rom then cool, that could be what they're using. I'm just saying I don't have a problem with it either way. Nintendo aren't given people many other options and need a good kick in the pants to get things done right.
