Nintendo of Japan confirmed Birdo is a boy in Mario Kart: Double Dash!!, and un-confirmed it in Captain Rainbow. However Captain Rainbow isn't part of the Mario series, and even Birdo looks different. So Birdo is a man, who thinks he's a woman, thus we can use both "she" and "he".
