Is it the console, the games, or both? If i remember correctly the wii could be hacked to play games region free which makes me believe that nintendo systems are locked but their games are not. What do you guys think?

It's both; it's just that a hacked Wii won't give a crap about what the region of the disc is. But it is plausible for Nintendo to release a disc that plays on all region Wii Us too (they did do that on the 3DS actually)

The discs have a flag that say what region they are. The system enforces the region lock by reading that flag and then refusing to play discs from outside of the same region.

This could be bypassed entirely on the system side, if Nintendo ever wanted to remove the region restrictions (or if the Wii U was hacked).

Yeah it has to be both. If the system and disc don't both have a region setting it can't be enforced. This is why I laugh at Sony fanboys that try to make Sony look like saints in regards to region locking. Games like P4A and the Korean RE6 being region locked clearly show that Sony put a region lock on PS3, and just chose not to enforce it.

Both Sony and Microsoft have gone with no region locks this gen only Nintendo is behind on this, 360 had stopped putting region locks on the games in the later years too.

Yeah like the Wii, and the 3DS, the Wii U is backwards with the whole region locking thing. It's pretty bad.

What's ironic is that the DS had no region locks whatsoever.
