Hard to say how much is wrong in all of this.

First, buying exclusives is not illegal at all, and therefor can't be sued. Any hardware house have the right to buy the rights for a product on their console. Actually, is the software house to pay a hardware house for develop on their console, most of the time...

Second, Titanfall is not even exclusive and so a wrong contender for such a role; it get released on Xbox360, XBOne and PC, that's 3 hardware (and Microsoft doesn't really own or pay for a "PC licence"...).
