Since it's going to be in 3D and old pokemon like Infernape are probably going to be in it. It may raise the ESRB and lose Nintendo some money, but it would be pure awesome for the real pokemon fans.
It would suck to have him not be catchable though, since he would die like Blue's Raticate, but I think it would be okay if there were uncatchable pokemon.
They could probably just release a different Mewthree as DLC and keep that one in the story.
