Since the EU courts have already ruled that you can sell on digital copies of games you bought without the devolper/publisher of the item having any say in the matter.

I would imagine the EU courts would quite happily rule the same thing if they do try to block the sale of physical copies of games, nor do I think they could try worm their way out of it saying "Yeah, you rent it for the consoles duration"
