you couldn't be more wrong. if you legally purchased the game in store or had it shipped to you early, M$ doesn't do anything. It happens with every game release.

This is vomitted out every time this topic is brought up and it's completely false.

The contract drawn up with the release of a game is between the store and the distributors. The customer has no part in this contract what-so-ever.
MS could possibly do checks on games that are played before the street release date, but if they check out as a legitimate copy (they can tell) then you have done literally nothing wrong and cannot be punished for it. The ones in the wrong would be the employees working in the store you bought it from, and the store or franchise operating the store would be punished if found out.

I have bought so many games that arrived a day or two early, played them online and not had so much as a warning e-mail.

You cannot and will not get punished for doing nothing wrong by either the ToU or the law.

People that get banned for playing a game early are the ones who download a copy before it has even shipped to retail, like in the case of Halo Reach and Gears: Judgment. In both cases the game was leaked on torrent sites before it had even gone into production. It was impossible to obtain a legitimate copy at that point.

Okay, so I was wrong. I'm just basing it on people I know who have actually gotten in trouble or even banned for that reason but their circumstances may have been different.

sorry, but those links do nothing but prove that you CAN be banned but it is not common practice. in fact, when people are banned it was a mistake. In the link about MW3, microsoft wasn't going to ban anyone, it was Activision. I think we know what most gamers think of Activision.

If the game is big enough and the street date is broken early enough, they're banning for it, and it's more common than you think....
