The reason they use a Peach is because it's NOT an apple. You don't get trademark rights because something sorta looks like yours.

And the person who said parody is right. Parody and satire usually are protected and when courts have been involved wins as long as its proven parody or satire.

As for Upton...maybe they have her permission? Also, isn't usually a likeness disclaimer in games and films?

yeah so many tv shows use stuff like pear pods and what not. Also yeah can't sue for using a character look a like.

Though I'm sure companies find a way to sue regardless.
