HVS has neither their own servers or the money necessary (well, they might have the money, but it's probably far better spent elsewhere, i.e. making the game).
Who ever said they paid lots of money to Nintendo is stupid.
To have your own servers you don't need Nintendo's approval, you just need money to keep running the servers every day.
If you want some hard evidence of Nintendo's networking rules, take a look at Bangai-O spirits. They could have used a server to host maps and such, it wouldn't have cost much. They didn't because it was against the "rules".
